End User License Agreement (EULA)

IMPORTANT NOTICE: By downloading, installing, or using this software (referred to as "Software"), you agree to be bound by the terms of this End User License Agreement ("Agreement"). If you do not agree to these terms, you must not download, install, or use the Software.

This Agreement constitutes a binding legal contract between you, as an individual user, and GLIMMEREYE VENTURES LIMITED, the exclusive rights holder of the Software. Please read this Agreement carefully before using the Software. Your use of the Software indicates your acceptance of the terms set forth in this Agreement.

Software Overview

The CyberGlow VPN app is a software product owned by GLIMMEREYE VENTURES LIMITED.

License Types and Grant

FREE LICENSE: CyberGlow VPN grants you a revocable, non-exclusive, non-transferable, limited, and perpetual license to download, install, and use the Software for personal, non-commercial use, provided that you comply with all terms of this Agreement.
PAID LICENSE: Upon payment of applicable fees and continued compliance with this Agreement, CyberGlow VPN grants you a revocable, non-exclusive, non-transferable, limited, and perpetual license to use the Software, in accordance with this Agreement.
UNAUTHORIZED USE: You agree to take reasonable steps to prevent unauthorized use or disclosure of the Software. This includes using at least the same degree of care you use for your own confidential information, but not less than a reasonable degree of care.

Ownership and Intellectual Property Rights

The Software is the exclusive property of GLIMMEREYE VENTURES LIMITED and is protected by copyright, international treaties, and other laws applicable in your country of use. The structure, organization, and code of the Software are trade secrets and confidential information of GLIMMEREYE VENTURES LIMITED. Any feedback, comments, or suggestions you provide regarding the Software may be used by GLIMMEREYE VENTURES LIMITED in its current or future products and services without any obligation to compensate or seek approval from you.

This Agreement does not grant you any intellectual property rights in the Software, which remain the exclusive property of GLIMMEREYE VENTURES LIMITED.

Usage Restrictions

You agree not to use the Software in any manner that could damage or impair the Software or hinder the enjoyment of others. Unauthorized access to any part of the Software or service is strictly prohibited. GLIMMEREYE VENTURES LIMITED reserves the right to implement legal and technical measures to enforce the terms of this Agreement.

You must comply with all applicable laws, including intellectual property laws, when using the Software.

Limited Warranty

GLIMMEREYE VENTURES LIMITED does not guarantee that the Software will meet all of your needs or that its operation will be uninterrupted or error-free. The warranty does not cover:

Modifications or alterations to the Software by you or unauthorized third parties.
Use of the Software in violation of this Agreement.
Failures caused by other software or hardware.

Except as expressly provided in this Agreement, the Software is provided "AS IS," without any other warranty, either express or implied.

Limitation of Liability

To the fullest extent permitted by law, GLIMMEREYE VENTURES LIMITED and its affiliates are not liable for any special, indirect, incidental, or consequential damages, including loss of data or profits, arising from your use or inability to use the Software. In no event will our total liability exceed thirty dollars ($30.00).

Third-Party Software

The Software may include components or third-party programs that are subject to separate licensing terms, including open-source or free software licenses. This Agreement does not override or grant rights beyond those specified in the third-party software terms.

Governing Law and Jurisdiction

This Agreement is governed by the laws of Georgia, excluding its conflict of law provisions. By using the Software, you consent to the exclusive jurisdiction of the courts in Georgia for any legal disputes arising under this Agreement.

Entire Agreement

This Agreement constitutes the entire understanding between the parties with respect to the Software and supersedes all prior agreements, discussions, or understandings concerning the Software. No other representations, warranties, or conditions apply, except as explicitly stated in this Agreement.
